Daniel Chapter One v. James Feijo

On behalf of Daniel Chapter One (“DCO”), this brief of petitioners was filed with the U.S. Court of Appeals for the D.C. Circuit, on August 18, 2010. The DCO brief argues that the FTC failed to establish jurisdiction over DCO and exceeded its statutory authority by misuse of its “reasonable basis” theory and test. Further, the FTC order is arbitrary and capricious, being the product of a blind adherence to the religion of scientism. Finally, the FTC action and order unconstitutionally abridged DCO’s freedom of speech, and the FTC erroneously dismissed DCO’s Religious Freedom Restoration Act and First Amendment “speaker autonomy” claims.

Rep. Ken Buck: The game here is not to take a tough vote. Nobody wants to take a tough vote, Democrats and Republicans, there's a quiet conspiracy going on that 'If you don't make me take a tough vote I won't make you take a tough vote.'

A "tough vote," says Congressman Ken Buck, means anything that cuts spending or programs that benefit political and corporate interests.

Rep. Buck: And the result is that the ability to cut federal programs or to reduce spending in other ways, or to get our tax structure under control- simplify the tax structure is very, very difficult. And that results in higher spending.

He says it's why Congress consistently spends wildly more money than it receives from taxpayers: six hundred billion dollars last year alone. Why the federal debt has been allowed to balloon to record levels: the U.S. owes about $20 trillion dollars it doesn't have on hand.

Sharyl Attkisson: Is there an element of that Democrats and Republicans may appear to disagree with things in public and yet privately agree because sometimes they cater to the same interests?

Rep. Buck: Sure, I think Democrats and Republicans disagree on some social issues and make a big deal out of that, and disagree on some other major issues. But for the most part, there's agreement behind-the-scenes not to make waves and to get things done quietly. Not good things, but things that involve spending more money. If I scratch your back you'll scratch my back.

Sharyl Attkisson: Is what you describe what some Americans might call 'the establishment'?

Rep. Buck: Absolutely. The 'establishment' are the Republican leadership and the Democrat leadership getting along and pretending not to. But clearly getting along.

Masterpiece Cakeshop v. Colorado Civil Rights Commission

Although Petitioner Phillips is a "cake artist" and seeks First Amendment protection for his craft, neither the CADA nor this case is limited to businesses that sell artistic services. The First Amendment rights of almost all other businesses in Colorado are at potential risk from CADA and the Commission's entry of its order against Masterpiece Cakeshop. In addition to the First Amendment's protection of artistic expression, several other general legal principles are violated by the injunctive and remedial order of the Commission.

CADA was adopted as a law governing "public accommodations," but it finds no support in the common law doctrine of public accommodations. That doctrine was borne of the necessity of protecting travelers from robbers along roadways in the night, where no alternatives existed. None of the reasons for the development of that doctrine apply here. It has always been understood that private businesses may choose with whom they may contract, with the narrow exception of places of public accommodation and common callings. CADA twists this narrow exception into a general rule.

Even CADA's term "sexual orientation" is problematic, as it reflects an entirely subjective and fluid concept, which could be said to apply to virtually any type of sexual attraction, however bizarre. And the record demonstrates that Masterpiece Cakeshop did not discriminate against the complainants based on their sexual orientation, as it was willing to sell its other products, only refusing to bake a cake to participate in and facilitate the celebration of a same-sex wedding, viewed to be immoral.

This case does not involve a persecuted and vulnerable same-sex couple oppressed by a Christian businessman. Indeed, it is better understood as a Christian businessman being targeted for state harassment for no reason other than his moral and religious views. Same-sex couples have myriad alternatives, and a decision to put a Christian business to the burden of defending himself in an administrative proceeding financed by tax dollars is abusive and destructive of small business and religious liberty. Such laws are an indicia of a totalitarian state, where the state will not allow individuals to be left alone, but must be brought to conform. Indeed, the imposition of a requirement to provide personal services upon demand has all the earmarks of "involuntary servitude" prohibited by the Thirteenth Amendment. Moreover, in the case of CADA, reins of power over the administrative machinery are held firmly by a Governor who is an ardent fan of homosexual rights.

evolution." It perceives an evolution that would bring us toward a modern, secular state, loosed
from the chains of morality. Doubtless, the evolutionary trend toward sanctioning immoral behavior
is occurring in the federal courts, but that does not mean that it is correct, constitutional, or
without consequence. Indeed, with an evolutionary view of "law," society moves away from anything
resembling the "rule of law," to "rule by man" exercised by unelected lawyers, acting as "philosopher kings,"
holding office as federal judges. Unable to obtain legislation fast enough to satisfy their appetites for
change, those who embrace sexual immorality appeal to judges to usurp the power to legislate for the nation:

Western society, in turning away from Christian faith, has turned to other things. This process is
commonly called secularization, but that conveys only the negative aspect. The word connotes the
turning away from the worship of God while ignoring the fact that something is being turned to in its place.

Dr. Schlossberg explains that to which society is turning are idols - "properly understood as any
substitution of what is created for the creator." Id. "When the society ... turns away from God
to idols, it is an idolatrous society and therefore is heading for destruction."
Id. "With their silver and gold, they made idols for their own destruction." Hosea 8:4. Various
judges, drawn from "'the highly secularized intellectual elite"' have appointed themselves to lead
the society toward the idol of sexual liberty. The temptation, Schlossberg concluded, is as old as
the Garden of Eden, where the serpent told Eve:

"'You will be like God, knowing good and evil.....' The biblical view is that God informs humanity
about what is good and what is evil, and the form this information takes is law... The alternate
view is in the temptation, succumbed to by Eve and her humanist descendants, to make autonomous
judgments about good and evil and so to be like God."
